Common Reasons for VAT Penalties in the UAE

VAT penalties in the UAE are usually triggered by one of the following:

  • ➤ Late registration or deregistration for VAT
  • ➤ Late filing of VAT returns
  • ➤ Late payment of VAT due
  • ➤ Submission of incorrect or incomplete VAT returns
  • ➤ Failure to maintain proper VAT records or invoices
  • ➤ Failure to issue a valid tax invoice or credit note
  • ➤ Failure to display prices inclusive of VAT

From 1 January 2026, the FTA replaced the previous percentage based late payment penalty with an interest based model. Unpaid VAT now accrues interest at 14 percent per annum, calculated monthly, starting the day after the original due date until the outstanding amount is fully settled. Fixed administrative penalties for issues such as late filing, late registration, or missing records continue to apply separately, and can range from around AED 1,000 to AED 50,000 depending on the violation and whether it is a repeat offence.

Grounds for a Strong VAT Reconsideration Request

A reconsideration request is far more likely to succeed when it is backed by valid grounds and clear supporting evidence. Common grounds we build cases around include:

  • ➤ Administrative or clerical errors that led to a late filing or late payment
  • ➤ A genuine misunderstanding of a recent change in VAT law or FTA procedure
  • ➤ Mitigating factors, such as evidence that taxable supplies were correctly accounted for despite a filing delay
  • ➤ Miscommunication with the FTA that resulted in an incorrect or unfair penalty
  • ➤ Unforeseen circumstances beyond your control, such as system failures or major business disruptions
  • ➤ Cases where the penalty appears to have been imposed without proper cause

Our team reviews your case, gathers the right evidence, and builds your reconsideration request around the grounds most likely to lead to a favourable outcome.

Documents Required for VAT Penalties and Reconsideration

The following documents are essential to review the penalty and prepare a strong reconsideration request with the FTA:

  • ➤ Trade licence and company registration documents
  • ➤ VAT registration certificate
  • ➤ Financial statements and invoices
  • ➤ Emirates ID and passport copy of the authorised signatory

Reconsideration applications must be submitted online through the EmaraTax portal, and the supporting request must be in Arabic. Our team prepares and translates your submission so nothing is delayed on a technicality.

FTA Response Timeline

Once your reconsideration request is submitted, the FTA reviews the case and issues its decision within 20 business days of receiving a complete application. The FTA then notifies you of the outcome within a further 5 business days of issuing that decision. Depending on the facts of the case, the authority may waive the penalty, reduce it, or uphold the original decision.

If Your Reconsideration Request Is Rejected

If the FTA rejects your reconsideration request, you can escalate the matter to the Tax Disputes Resolution Committee (TDRC) within 20 business days of the rejection. Escalation is not available if a reconsideration request was never filed with the FTA first, or if the disputed penalty amount has not been settled.

The TDRC reviews the case and issues a decision within 20 business days, which can be extended by a further 20 business days in certain situations. Its decision is final where the penalty amount is below AED 100,000. For penalties above AED 100,000, businesses can further challenge the TDRC decision before the Federal Court within 20 business days of notification. Our team can guide you through this escalation process if your initial request does not succeed.
